Encaix Comunicació Visual, S.L. (hereinafter, "ENCAIX") provides additional information concerning the processing of your personal data, as established by the relevant regulations: REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 (GDPR) and Organic Law 3/2018, of December 5, on Personal Data Protection and Guarantee of Digital Rights. In this regard, and aligned with ENCAIX’s privacy policy based on the layered or leveled information model, we present below the additional information (second level) with detailed data processing information you should know.

FOR WHAT PURPOSE DOES ENCAIX PROCESS YOUR PERSONAL DATA?

At ENCAIX, we process information provided by individuals interested in our services for the following purposes:

  1. Managing your contact request.

  2. Managing and informing about our product and service promotions, as well as those of third-party collaborators.

  3. In the case of job applications, processing your application, keeping you informed about the hiring process, and notifying you of future job opportunities in our organization.

  4. Maintaining the contact database.

  5. Managing customer complaints, claims, suggestions, and recommendations, which may involve providing services or carrying out related work to resolve them.

  6. Additionally, if you authorize it, we may send you our Newsletter with information about ENCAIX products and services.

  7. In some cases, segmentation tasks may be carried out. Segmentation or profiling may be performed for targeted advertising. No automated decisions are made based on profiles. In no case will segmentation or profiling by ENCAIX have legal or significant effects on the data subject.

HOW LONG DO WE KEEP YOUR PERSONAL DATA?

The data provided will be kept for as long as the business relationship is maintained or for the years necessary to comply with legal obligations.

Regarding the Newsletter, personal data will be kept as long as the subscription is active and deletion is not requested by the data subject.

ENCAIX periodically reviews data retention periods, deleting data on its own when information becomes obsolete or outdated.

WHAT IS THE LEGAL BASIS FOR PROCESSING YOUR DATA?

The legal basis for processing your data is based on the consent granted by completing any of the forms ENCAIX provides in its services.

The withdrawal of consent for receiving the Newsletter does not condition the maintenance of consent for the services relationship and vice versa.

TO WHOM WILL YOUR DATA BE DISCLOSED?

No data transfers to third parties are expected, except those established by law as mandatory.

Certain service provider companies, acting as data processors, may access the data solely to provide the contracted service, following ENCAIX’s instructions and without using it for any other purpose. All providers sign confidentiality agreements in compliance with current regulations.

WHAT ARE YOUR RIGHTS WHEN YOU PROVIDE US WITH YOUR DATA?

Anyone has the right to request access to their personal data, its rectification or deletion, the limitation of its processing, or to object to its processing, as well as the right to data portability. You also have the right to withdraw consent for any of its purposes. To do so, you can send a letter to ENCAIX, Commercial Department, at Pl Pompeu Fabra nº10, 17002 Girona, or email (include email address if applicable), indicating the action you wish to exercise. Proof of identity must be provided, along with a copy of your ID.

You are also informed that you have the right to file a complaint with the relevant supervisory authority (Spanish Data Protection Agency) if you believe any kind of infringement has occurred regarding your personal data processing.

If you request the limitation of the processing of your data, we will only keep it for the exercise or defense of claims; in the case of objection, the data will no longer be processed unless there are legitimate, compelling reasons or the exercise or defense of possible claims.

ENCAIX has adopted all necessary technical and organizational measures to ensure the security and integrity of the personal data processed, as well as to prevent loss, alteration, and/or unauthorized access by third parties.

ENCAIX reserves the right to modify this policy to adapt it to legislative or jurisprudential changes and industry practices.

WE VALUE YOUR COOPERATION

At ENCAIX, we strive to control, within our capabilities, the proper use of the personal data we are responsible for by third parties to whom we may have to provide it. Therefore, we request that if you become aware of or suspect any misuse of your personal information by any of our providers, you notify us promptly so that we can take appropriate action.

To ensure the data we have is correct and up-to-date, we kindly ask that if any changes occur in your data, or if you detect any inaccuracies, please notify us as soon as possible to proceed with the appropriate correction.
